Letting agents failed - do we stand a chance ?

    Why not wait and see if the OP returns to the thread as your interpretation of post no 1 may be inaccurate. I read it that the T has *not* claimed the deposit, as the OP refers to there being circa 400 quid available after cleaning fees were paid out, presumably organised by the LA.

    The OP has not yet posted in response to my earlier query about whether the deposit has been properly dealt with, ie scheme registered with prescribed info provided within appropriate timeframe.

  • I would never use an agency to manage, I would use them as an introduction and contract writer and then inspect myself.

    Absolutely, but not uncommon for them to be accompanied during the visit

    Re-reading, I think you're right.

    She said in the original post that the tenant had claimed - ie, requested repayment - which I then interpreted that as the deposit had been repaid. I think she's saying that it hasn't been as yet (as far as she knows, but with this agent...?), hence - with the costs for the lacklustre clean deducted - that leaves max £400ish available for her.

    Except I rather suspect that even if it hasn't been paid yet, the shoddy agents have no way of proving the validity of any deduction, since there's no inventory or check-out, so it'd be repaid anyway.

    An infant 5 years ago would now be a 5 year old. And in 5 years a child can do quite a lot of damage. What were you expecting?



    What a ridiculous statement. Landlords should not expect damage to a property just because a child lives there. How offensive to parents too. Many are able to have children that don't wreck the home. Also any damage done by a child would be deducted from the deposit not accepted as a consequence of renting to a family.

  • my dad had similar situation with a tennant who left his house in a mess, didnt use a letting agent

    the tennants had left and deposit didnt cover the repairs and they owed a months rent

    he was out of pocket by about 1500

    he had a word with a solicitor friend and was told that its not worth the time and effort of chasing as frequently the kind of people who trash a house often wont have any assets to go after in court
    solicitor said that he was lucky they werent squatting there and hadnt done more damage and to just be more selective in future when accepting tennants

    as its a letting agency you can possibly try going after them in court
    or via money claim online. taking them to court for not doing their job could easily be expensive and you arent guaranteed to win

    my dad was advised to take photos or video of everything inside house at time of letting in future as proof of the initial state

    The worst thing about the situation is you have been paying the letting agent for nearly 5 years without them doing their job. Over the 5 years you have paid them £5460 in fees, really you should be able to ask for this back.

    I don't trust estate agents or letting agents, i know i am going to get belted for it, but lets be honest there not the most trustworthy.

    So why would you trust them to look after one of your most prized possessions?
