No one is saying you don't deserve either the item you paid for or a refund.
People are saying that your child is not going to be traumatised by this, aka 'what will you tell him on Christmas morning'
Nothing. He won't know.0 -

Hi Chris,
you say the company won't do anything because 7 days had passed, I can't work out from your post if you were away for the 7 days or not?
I totally agree that if you ordered x and received y, you still want x!
Have you gone through Amazon? Email them to explain that you ordered and paid for the first car, but the company accidentally sent the wrong one and won't fix it before Christmas.
I hope they fix it for you!0 -
Of course you could always contact the company and ask them if they will refund you for the incorrectly delivered item if you order and pay for the correct one.
although if they've mucked up the order once what's stopping them mucking it up again???2014 Target;

You've been given the advice, you're entitled to the item you paid for. If you want you can re-order the correct item in time for Christmas while waiting for the current item to be refunded.
Specifically you are entitled to reject the incorrect item for a full refund as per the terms in the Sale of Goods Act.
I'm assuming here that the car can be diassembled. If not then you may be deemed to have a accepted it.0
