Getting My Money Back?

Hi all,
I hope someone is able to assist me with a problem I currently have in relation to getting a refund from a company. Its a long story, so apologies in advance.
Approx 2 months ago I order items online from a company and paid via my credit card. The amount (incl p&p) was £113. The items were despatched via TNT parcel delivery and they attempted to deliver several days later but I was not in. A card was left advising me to re-arrange delivery. This I did, but unfortunately, I missed the 2nd attempted delivery so the items were returned to the company that I ordered from. I have since been in touch with the company via e-mail and requested that rather than they re-attempt delivery, I would rather a refund of my payment (I have specified that I am happy to deduct the amount of the original p&p). The person I have been e-mailing has been happy to accept this and stated that he would pass this on to their accounts dept to arrange. However, this has dragged on for several weeks now and every time I contact the same person, I simply get an apology and a promise that he would urge the account dept to sort it.


My question is, is there any more formal avenues open to me in order for them to refund my payment?

    The Distance Selling Regulations says goods must be delivered within 30 days unless agreed otherwise, and if they are not then the contract will be treated as if it did not exist and all money refunded. It's not completely clear from your post whether it was your fault that the delivery failed or not which may change that.

    However that's a bit of a moot point since they have agreed to a refund. If you paid on a Credit Card then you can claim the money back from them using a Section 75 claim. The credit supplier are jointly and severally liable if the item is more than £100.

    If Section 75 does not apply then you can still contact your card issuer and ask to do a chargeback. That isn't a statutory right but still may work.
  • One point to mention is that for Section 75 to apply, the value of individual items must be a minimum of £100 each and not just the value of the total order that was placed.
