repayment from Nationwide

Hi All
I have had an offer from the Nationwide I took them to the FSO and they have made an initial offer less 8% interest which of course I am refusing.( I want it all back) I am also requested the money should be paid to my new bank . The Nationwide are refusing they wish to use the money to pay off a debt I have from the currant account which I am paying off by arrangement with them.
The FSO believe the Nastywide have a point,
My point to them is this, if they had not of ripped me off in the first place I would not got in a financial hole so give me my money it’s not yours to decide where it goes.
Any body know of a similar situation who could give me a bit of guidance .

  • Firstly i would have thought because you already have a agreement to pay the debt they shouldn't be able to change that agreement after all if for some reason other monies were to be put into your account equal to or more than the debt they wouldn't touch that would they?..i think its a case of we take the money, clear your debt, then tell you they are closing the account..and secondly i agree with you its your money and you should be able to have it refunded to where you want...it just them being down right akward i think, but hey i am no expert lol

    If there is an outstanding debt with the bank or credit card company involved, which is not the subject of a separate contract, they can and will offset any monies reclaimed against that debt.
    The acquisition of wealth is no longer the driving force in my life. :)

    Best guidance you can have is to accept the offer Nationwide have made you, after all it is the full amount of your claim and you would be hard pushed to convince a judge that you have a good reason for turning it down.

    Please read Martin's article regarding claiming interest, this is awarded by the court and can only be used as a bargaining tool in the initial stages.

    As regards the bank paying the money into another account, while there is a debt situation they will pay any monies reclaimed into that account, whether it is open or closed also if interest is frozen on such a debt they are likely to start charging interest on it again.

    Hi,
    I am filing FSO tomorrow as Nationwide have not got back to me within the 14 day's of when I sent the letter saying I was filing court proceedings.
    I also have a debt with them, an Over draft of one thousand two hundred and I too have an agreement to pay it off monthly bit by bit but I will use the money I get (If I get any) to pay off the over draft as I see it as one less debt to worry about and then I'm moving accounts and don't have to worry about them any more. I am claiming two thousand and eight hundred pounds so am hoping for at least two but will see.

  • Hi Tracey go for all of it with 8% ,its your money it takes a bit of time, but they will get you your money all £2800 plus interest . then good ridance to the (Nastywide) .

    Hi Glenn, I've recently put in a claim against the Nationwide to the Ombudsman as well (Filled in the form on the 14th June), how long has it taken for you to get an offer since you put your claim in to them?

    I don't see why they shouldn't pay you in a way which suits you, it's your money, and as you've said, you've already made arrangements to pay off the debt owed.
  • Hi i called them and sent my first letter 5th of march . not too long after years of bull from the Nastywides customer (dont) Care department.
