My car has been written off. Do I still own it?

    No one, as there is no insurer involved.
    Even if you have not told your insurance company about this situation, they could find "your" car popping up on a list of back-on-the-road retested and recategorised cars; now you have broken your contract of utmost good faith with those lovely people who are always on your side, called your insurance company.
    It's not written off if the insurance company hasn't registered it as such...

    Does the insurance company know?

    What is going in the what are your traffic offences and have you been involved in a motor accident section on the proposal for for the replacement car?

    If the answer to both those questions is NO then the OP needs to trust the party, to whom he is selling the crunched motor, to keep shtum too and pray that nothing nasty will come to light next time it is sold or crashed.

    This is basic Common Law and dates back to when people used to have horses - or 'work horses'. They performed a certain function. Travel, ploughing fields etc

    The 'relics' of this important fact are still in use to this day. Why do you think engine output is still measured in horse power (hp) and break-horse power (bhp).

    Many Motor Traders will offer to do similar, especially bodyshops or car sales, I'd say sell the damaged car to them, so you can't be pursued for selling on an unfit motor that may be a Cat C or D write off.





    However be aware that by admitting liability and giving you a payment, they have prejudiced their own insurance, should you have subsequent injury problems.

    Ideally, I'd like the claim acknowledged by the Motor Trade insurer on how you are agreeing to settle, so if there are future issues, you know the incident was logged, and the claim file can always be re-opened.
