Internet company will not give refund

I bought a tablet on the cheap disability aids website. The description of the item when purchasing seemed really breakthrough they did not name the make. After receiving the tablet it was damaged with a big scratch down the back and blue ink on the reset button which makes me believe it was already a returned item. I paid around hundred and forty pounds for the tablet and when looked the tablet up on other sites its being sold for around sixty pounds. I asked for a refund but the company ( after God knows how many emails I sent to them) have refused to refund my money and have offered a replacement I feel conned. I'm absolutely disgusted by this company. They have said to write a letter to them and they will reply in 30 days. Do you t think it is worth seeing a solicitor as this is now not about the money. The customer service were extremely condescending and I'm left with no tablet for my little boy for christmas

When did you receive the tablet? Have you told them it is faulty? The fact you could have got it cheaper elsewhere is irrelevant.0

How did you pay for the tablet?0

I received it on Monday and sent an email straight away outlining the damage. But they will not give a refund just offered to exchange the device.0

I paid by direct debit0

Sorry, what do you mean by "Direct Debit"?
Are you paying in installments?0 -
Your next step is to write them a letter stating that the device is faulty and that you wish to reject it for a full refund, as per your statutory rights under the Sale of Goods Act.
Get a proof of postage as well.0 -
if it's this tablet then it's showing as currently out of stock anyway. You have every right to return under SOGA for a full refund, and I'm sure for not much more than that cost you can get a much better specced tablet - I can't see anything about it that justifies the 'special needs' tag that it's been given0

Would rejecting it under Distance Selling regulations be better than Soga?Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked0
