The only matter before the court is a repo. They will not hear an argument about affordability. I tend to think OP may have chronic arrears problems for the lender to try and thwart payment by underhand means. But underhand means of getting a court order are never good for justice and courts tend to recognise that.Thrugelmir wrote: »While the arrears may be resolved.
