HTC failed to repair phone for over 4 months

The HTC One S phone I received as an upgrade on my pre-existing contract with Three in July 2012 has completely died in August. I sent the phone for warranty repair - HTC dealt with it under warranty and in ~ 3 weeks time I had my phone back. There was only a one little problem - the screen was scratched. I raised the case with HTC and sent it back to them. They said that they have repaired it , but they didn't - scratch was still there (late September). So I sent it back again for the third time. The phone was held "in repair" for almost a month. I eventually received the phone back and it was a brand new phone. What would be great if not one minor detail - the phone radio does not work. It doesn't catch signal, it can't be used for calls or text messages (Wifi works fine).

I'm really fed up with HTC at this stage. I requested a refund, but they have refused to refund me and offered to take the phone in for repair again. I'm hesitant to do so, as this is going beyond any reasonable limits. Also, after 4 months I have a little use for the phone as I have purchased another one.

I'm thinking about taking the case to a small claims court, but can I do so if I got the phone from Three? Do I have grounds to make such claim (market value of the phone + postage I paid for returning the phone numerous times)?

    If you didnt buy the phone then i doubt you will get any money back especially not market value.

    You will be offered a replacement or an alternative.
