First action, whether they are right or wrong, would be to remove the image(s) and replace it with something equivalent that you are sure is not under Getty copyright - a photo taken by yourself for instance. If they continue to persue the claim after the image has been removed seek advice. Copyright of web images is a difficult subject and it is important to be aware of the issues - best always to use what you know is in the public domain, things like Creative Commons or self produced are easiest. Your web design company should be aware of all of this.0

Nice way to make a little money by Getty Images, you paid for a website to be created so you would have hoped that all images and content were original and any permissions obtained.
The people who created your site need to be aware of this as if they are using images without permission for other sites they are potentially creating problems for other website owners.
I would hope that removing the offending image would be enough but as they have come in with an invoice rather than a request I doubt they would let you off that cheaply.
Myself I have had my own photos "swiped" off the internet and used by local newspapers without permission. I'll be writing a letter to the local authority who have taken and used my photos (having cropped my details out) and used them on their website - I will just request that they are removed.
People need to learn that just because things are on the internet does not mean they are free but it should not give the owners of these photos the opportunity to charge absurd fees.0 -
Thank you for your comments Spenderdave and Whiteknight, I would not allow the use of these images if I had known it infringed copyrights, there are plenty of pictures out there that are usable or indeed we could take our own. The image in question has now been remove from our site, I looked on Getty website and to use the image is £470 which is still a lot of money, but I've got no idea how they came to the figure of £1500????0

It's not an exact calculation, and they'll try to get whatever they can. But obviously the price they'll ask after infringement of copyright is going to be much higher than if you'd purchased the image rights properly. Offer half of what they're asking and negotiate from there.
