Renting advice on landlord ending tenancy

    Well, not until either -

    A. You are evicted (which by sounds of it wont be before march)
    B. You get a large wad of cash.
  • Well the sale fell through. We have been inundated with viewings and it's become a bit ridiculous. We've told the the estate agents that they can only come round one evening per week and all viewing have to be undertaken then. They tried to say that if they gave 48 hours notice they could legally enter the property but I've checked the tenancy and it says we have to be reasonable to viewings. I've told them that and they have backed down...

    We've received the stat notice to quit. Looks like we'll be looking for somewhere else to live soon. However the landlord has since been in touch and said if it's not looking like a sale will go through before we need to leave he will give another 6 ,month contract.

    I'm not sure I want the hassle and think it's probably best to find somewhere else to live

    A s21 notice is a legal notice that the landlord will seek possession through the courts.

    A notice to quit is a rough bit of toilet paper.
  • There's no such thing as a "Notice to Quit" but there is such a thing as a "Section 21 Notice". This is precisely that: a notice. That the landlord intends to apply to court to have your tenancy ended. Until that time you are legally entitled to remain in the property if that is what you wish to do.

    If I were in your place I would refuse all viewings and make my intention to the landlord and their agent that I will not consent to them under any circumstances until and unless they have a court order. I'd be putting this in writing. (In a letter. Not a text-message, an email or any other informal means of communication.) And then I'd be changing the BARRELS of the locks, keeping the old ones to swap back on the last day of my tenancy.

    Then, I'd be looking as hard as possible for another property.

    Eventually you will have to move and after all the hassle with these viewings I'd look to move sooner rather than later. I wouldn't want to give the LL 6 more months of my hard earned money. This LL is definitely trying to have her cake and eat it.

    If she's offering a new contract, get the OFFER in writing. That negates the notice (S21) served and gives you a little more time without any commitment on your part. In effect, you will be in a statutory periodic tenancy and the LL will have to serve a new 2 months notice to start possession proceedings. YOU, on the other hand, could leave whenever you want as the LL actions in serving the S21 are incompatible with the continuance of the tenancy.

    At some point, in the not to distant future, you will have to leave. All this does is buy you more time. But time is a valuable commodity.
