Control Account "Letter Before Claim"

Good afternoon,

I am new to this so you will have to bear with me and pardon my ignorance. Some time ago I parked on a Euro Car Park in my local town (North West England) and never bothered to pay for a ticket as I have read that technically I didn't need to.

I received their letters which I ignored as I have read many times. In the past I have had no issues and never had any repercussions. This morning however I have received a letter from Control Account PLC entitled 'Letter Before Claim'.

I have read various threads on here this morning and I am a bit confused. The way I understand it is if I receive the letter from Euro Car Parks or the private land owner I have to respond but as it it is from Control Account PLC, the debt collector then I can still ignore their letter?

If I do have to respond can someone point me in the direction of the best course of action for the response?

Will I now inevitably have to pay?

Lastly, the letter states I have 14 days to respond and it is dated 12th (although it only dropped on my doorstep this morning) so as you can appreciate I need help quick!!!

Thanks guys!!!

We never advocate not paying for parking where there are clear signs that this should be done. e.g. a P&D car park. It is actions such as yours which make companies think PPCs like ECP are legitimate.

Who has signed the letter ?
is it a solicitor ? or the office cleaner ?
    Be happy...;)
  • Firstly, Control Account are just debt collectors and can't take you to court - only the landowner or Euro Car Parks ( in certain circumstances ) can do that.

Secondly, Control Account claiming to be a PLC is a complete lie - try to find their shares listed on the stock exchange ? You have three options :

    1. Tell CA to return the account to their client as you deny any debt.
    2. Ignore
    3. Point out to CA that they aren't a PLC and would they like you to raise this with the authorities ? ( this would be my choice but then I'm an argumentative so-in-so !!!! ).

Can you contact the Solicitors Regulation Authority and make a complaint about this "legal executive" as she / he appears to be passing him/herself of as a solicitor as he they no right of audience to act in litigation for a third party company and is therefore issuing documents fraudulently representing the legal profession in attempt to deceive the recipient they are in fact solicitor .

If this is not the case, they trawl here enough, perhaps they would like to explain what they are playing at.
A criminal offence would be my assumption.
    Be happy...;)
