Advice with UKPC Parking Ticket

    I have drafted this response, and recorded UKPC informing me over the phone that they will not be issueing me a POPLA code, as I dont have this in writing.

    I have pinched one or two things from elsewhere. Any advice, input would be greatly appreciated.

    To whom itmay concern,

    As I am yet to receive a response to my latest appeal, received by yourself on the 23rd of January (Royal Mail Tracking Number: KF695193177GB) I am wrighting again. My recent communications with a member of your staff have informed me that you are no longer considering my appeal, and therefore are unable to issue a POPLA code(Conversation included on USB stick) – although no written communication has been received which declares that my appeal has been rejected. Further communications from “Debt Recovery Plus Ltd” indicate you intent to take me tocourt over this matter.

    If following from this letter you do not confirm that this matter is not proceeding and the charge is cancelled, I would still like for this matter to be resolved by the by an ADR ie POPLA.

    Failure to agree to this would be evidence of UKPC failing to mitigate your alleged loss. This will of course be drawn to the court's attention as well as your unreasonable behaviour, obfuscation and delay.

    Latest intelligence suggests court costs are substantially more expensive than the tax-deductible £27 a POPLA decision costs. Should therefore the case go to court, due to an-unsatisfactory resolution following this letter I will invite the Judge to apply the principle of Halsey v Milton Keynes General NHS Trust [2004] EWCA Civ 576 regarding costs.

    If you reject this resolution and proceed to court I will robustly oppose any costs over £27 and will in my first defence statement, ask the court to stay the case and insist on a POPLA decision instead. I entirely reject your self-imposed 28 days guideline and indeed POPLA have confirmed that a code can be issued by the operator at any time. The 28 days is merely a timelimit that starts when the code is generated and sent to the motorist and I will state this fact to the court if UKPC suggest otherwise.

    I look forward to a response within 14 days.

    I think I got them all now.

    I did it on word, none of those red lines I fear so much (being dslyexic).

    I think copying it from word to the forum, some of the spaces have been removed for some reasons. Have got rid of most of them I believe.

    if copying onto the forum , first copy from word into notepad and save as a txt file on your pc/laptop

    then copy and paste from NOTEPAD onto the forum, saves having any formatting issues and quicker than editing your post afterwards
