Parking fine from Parking eye

Hello

I recently received a parking fine from Parking eye due to staying in apopular local supermarkerts carpark for a few minutes longer than allowed. This delay was due to the unfortunate fact that I was blocked in their carpark and so couldn't leave.

I emailed the supermarket to protest this and was advised to send in proof of purchase to have the parking ticket rescinded. I provided this but was advised by their customer service representative that as I'd only spent a low amount in the store they are not prepared to rescind the ticket despite the fact that I was unable to leave the carpark due to circumstances beyond my control.

Can anyone advise what my next steps should be? The customer service representative has advised me to speak to the store manager but I'm a bit stressed about having to do this and I'm not sure what this will achieve.

The way I see it is I have three options:

1. Speak to the store manager - which may just lead to getting more stressed.
2. Pay the fine - which is now up to £70 which I can't really afford but would at least ensure that I avoid any further stresss.
3. Take a militant approach and ignore any further correspondence.

Any advice?

    For a start , this is not a "fine", it's an invoice. Was this Aldi by any chance?

    One thing you cannot do is to ignore Parking Eye. They are taking people to court if you do that. They can easily be defeated at POPLA, if you but in the killer points of now genuine pre-estimate of loss and theri lack of contract to issue these invoices. Don't worry you won't have to pay them a penny.

    It was indeed Aldi. I'm not familiar with some of the terms you're using below. I take it by POPLA you mean using the appeals process?

    I'm happy to do that but not entirely sure how to word a letter to them. Are you aware of any letter templates that I can adapt?

    You do need to do quite a bit of reading as you're not yet familiar with the very basic terms.

    How much did you spend & how much would have been necessary to get the charge cancelled? It would be a very good idea to get confirmation from ALDI of the details of this secret "I'm A Genuine Customer Get Me Out Of Here' clause.
  • It was my lunch that I purchased so it was only for a few pounds. Apparently you need to spend £30 or more to be accepted as being a genuine customer!! I've been to see the store manager but there was nothing he could/would do. So I'm now in the process of submitting an online appeal to Parking eye. Unfortuantely the signage at the car park has now changed as a result of the supermarket introducing a new system where you have to key in your registration which doesn't help at all!

    You will win if you raise the question of genuine pre-estimate of loss. PE have lost over 70 POPLA adjudications that way. If you want any help in drafting up that appeal there are plenty of people on here who will help.

  • Thanks - I've submitted an appeal based on genuine pre-estimate of loss, ten minutes not being sufficient grace period to exit the car park and the fact that the signage has all been replaced in the last couple of weeks which suggests that it was previously inadequate.

    Fingers crossed :-)
