Ah! a Portia! Thanks. An arrow to put in my quiver.

Wouldn't you have been better thanking pogofish for showing you the thread of advice and pointing you to the right sub-forum for your situation? At least Crabman has moved your thread away from the advice that is wrong but means well.

You simply need to read other threads about lease cars and private parking tickets, easily found by searching this sub-forum for the word 'lease'. I recall a really good one a few months ago by 'MacBudman'. You need to dispute this payment of course, so the first thing to do is to dig out the t&cs of your lease hire.

Show us the EXACT wording in the lease t&cs about 'charges' like this. It's not a fine and they should never have paid it.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I have thanked Pogofish as I did Crabman. Your forum information is the most succint I have read.

I will research this and come back to you.

Does anyone know what action can be taken against traffic using these rear or secret service area entrances? I quite understand the problem of traffic using these country rat runs but it would be valuable to know the law on this point so we all know where we stand.

Presumably you have already read this:

All these signs saying 'Authorised Use Only' or 'Restricted Access' or Works Units Only' are just there to keep away the faint hearted.

Just watch out for RAF Welford! ;)

You need the wording from the lease company terms, I would bet my house on it saying, penalties, congestion charges, toll charges and fines from an authority. None of these are this! So it means they are in breach of their own T&Cs, and it may mean they will debit your card. If that happens you need to dispute with your bank for an unauthorised debit.

It also means that you should try and nip this in the bud and inform the lease company not to debit your card, and you will issue a small claim against them if they do this. They are acting beyond the bvrla guidelines that tell them that they should name the leasee as indicated by the Protection of Freedoms Act 2012.

Don't wait for them to act go on the attack now! Also make complaints to the landowner on the inadequacy of the signs, and that you didn't park there for those hours, inform them that you intend to take legal action against them for the actions of their agents.
When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Thanks for this. The car lease company has not taken the money yet but has found me guilty & seems to think it done me a service. I am about to disabuse them.

Is it time motorists got to together and exercised their muscle by "striking" by making a concerted effort to avoid the road, fuel and car parks; thereby denying their revenue stream to those Government departments and private companies who are depending on them more and more. Straws and camels backs etc.. I think we could get 'em worried?? Not easy but we can dream!

I wrote to the parking company explaining that I had left by the open gate and had photographic evidence to prove that I was not parked at Strensham all day. I informed that I would fight it through the Courts and make a sure I never used their Service Stations again. I did receive a letter saying they would not pursue the claim and would refund the charge to my car leasing company. I now visit the new M5 service area near Gloucester which is a delight!

very surprised at your outcome. I would expect these companies to never issue refunds for "invoices" already paid.

In any case, why are you still boycotting the service station after they have agreed to refund you?
