Parking in Scotland

Hi
I have read lots of posts which have been very helpful.
This will sound daft but I presume a charge notice received from TPS should still not be replied to, even though it is possible that the parking signs were ignored!
My wife is the RK but my son is the driver and I suspect he parked in a Homebase car park in Edinburgh for just under 3 hours whilst he did not shop there and basically just used it as a free parking space.
He is abroad at the moment so I cant confirm with him till next week.
My wife is not at all happy about this as she does not want threatening letters sent to her.

Your wife as the RK will, unfortunately, receive a string of letters. But she should ignore them as in Scotland PoFA doesn't apply, so the PPC can only pursue the driver. They can not touch the RK.
I'm sure Mum won't dob in her son, will she?
When he gets back, she can kick his @ss for the trouble he has caused her, and you can tell him from the forum that if a ticket is needed to park the car, then he should buy one on the day! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Wise words Umkomaas, thanks. He will learn a lesson shortly.
I am going to show this posting to the wife to confirm that no further action can be taken by TPS as long as my wife does not approach them with the driver details.
Ironically before I found this brilliant forum, that was exactly what she was going to do.
Thanks again0 -
I got a ticket for parking in the PRI car park.
I locked the car then went to the ticket machine and got a FREE ticket but because it was pouring with rain I never walked back to the car to put the ticket in it.
I did leave the slip from my appointment letter on the dashboard.
When I got back to the car there was a ticket on the car.
I then got 8 letters basically saying pay up or we will take you to county court.
I never acknowledged them.
Then I heard nothing.

Search the forum for the keyword 'Scotland' and read the ''NEWBIES read this first'' thread again as I hope you did before posting...Scotland is covered there and there's a Watchdog video to make you laugh. I presume you missed it and had not yet searched the forum for 'Scotland' either.
So much info already on the forum, read threads by chickadee13 and mimosaDR and dozens of others every day who ask the same thing even though it's already in the sticky threads...all of it will come up with one search.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I did all the above Coupon-Mad.
I think all posters were complaining about being incorrectly receiving parking charges.
My point was that the firm may have been correct in issuing the notice but I guess they have no way of proving it.0 -
That's not the way I read most threads here (tickets are a joke but normally have some basis, like alleged overstay) but glad you've read up on it. Have you shown your wife the Watchdog video which applies to Scotland/NI fake PCNs and explains why naming the driver would NOT be a good plan?
People have happily & safely ignored the entire letter chains for years, myself included, I laughed at my fake PCNs and I am just an ordinary wife and Mum. I carry examples of the debt collector letters in my handbag to show colleagues & friends about the whole scam. And that's why I post here now.
The ''PPC letter chains'' sticky thread link to the pre-POFA letters (links to another MSE thread) would be good for you to look at as well so you can predict the next letter in the chain each time before they arrive. Play a game of snap with each letter as we used to in England before the advent of POFA2012 and POPLA wins.
I also tell my 2 young adult nieces and my 4 teen/young adult children never to pay a fake PCN - they all know it even though only a couple of them drive! That's the most important message to tell your son, don't be harsh on him...maybe wind him up a bit first though!!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Stop taking these bams seriously - They have no right or authority to issue any kind of penalty beyond the actual loss to anyone - and that is not going to be a lot in a free car park!0
