Hi, the vendors will not be supplying the following:

- Head Lease
- NHBC certificate
- Possessory Title
- Boiler service certificate
- Indemnity insurance

The environmental search has failed.

Which documents are necessary for the exchange to take place?

    Are you a cash buyer?

    If you need a mortgage, your not going to be able to get the mortgage without some of those. Your solicitor will probably be advising against it - and i would listen to them.

    Have they given a reason for non supply? I wouldn't proceed myself. How/why has the environmental search failed? If you do pull out, surely the vendor will have the same problems with any other buyer?

    The solicitor is happy to go ahead with the exchange without the documents.

    I don't understand why I have to fork out for a bunch of indemnity insurance policies.

    You dont have to, but then you cant get the house.

    Im surprised the lender will let it complete and im very surprised your solicitor has no issues.

  • I wouldn't touch this property with someone else's bargepole! Most especially because of the lack of head lease and possessory title. I don't understand why the solicitor would be happy to progress without these.

    i was under the impression that compulsory land registration makes issues missing titles something from the past, yet an NHBC certificate last for 10 years, and they've not been around for much longer than that, so for one to have ever been present the it must have been built after compulsory registration

    - Possessory Title NO
    - Boiler service certificate YES, if I'd had it inspected or planned to replace it
    - Indemnity insurance Depends what theinsurance isfor!

    None are necessary unless you are getting a mortgage and the lender insists. Some/all are advisable.

    Ging - not all property is registered. I know of 3 in my town that aren't on the land registry.

    That's to do with change of ownership, and when it last happened. this sounds like a recent build
