gas safety check

my land lord has said gas safety check is due and i have to pay £35 for it is this right, do i have to pay for it? thanks for any advice

    What does your contract/Tenancy agreement say on the subject?
    The Landlord is required to get it, not you. So if nothing in writing I'd suggest it's down to him.

    As above. What did you agee when you signed the contract?

    However, if you refuse to pay for it and it is not done, it is the landlord not you who is prosecuted.....

    Alternativeley, if you refuse to pay and the LL gets it done, he could sue you, or deduct from your deposit, assuming you have contractually agreed to pay.

    His responsibility in law to ensure the certificate is issued/kept up to date.

    That is not the same as determining who is contractually bound to pay for it (though I agree it is generally accepted to be part of a LL's costs).

    And no doubt using it as a cost for tax reasons.

    I have always taken it to be my responsibility when I have had a lodger. It has never occurred to me to charge the lodger for it. Have you checked your tenancy agreement to see if it is given as a requirement? is he charging you and then claiming tax relief on it as a expense?

    The Gas Safety (Installation and Use) Regulations 1998 take precedent over the contract/tenancy agreement and a landlord cant discharge their legal duty under the Regulations.

    Gas safety (Installation and Use) Regulations 1998; Regulation 36(10) applies

  • How difficult is your landlord? Yes, it should be his responsibility to organise and pay for the safety check. But if he insists you cough up and you contest it, there's a chance he may retaliate with an eviction.
