Redundancy while on caring leave

This post is for a aunt of mine that has been told that she is likely to be made redundant. At present she is on caring leave for an older relative that is in the latter states of Alzheimer and that unpaid leave ends at the end of April.

The company is pushing her to take redundancy now and has give conflicting information. She feels that they want to get rid of her and is giving her a small redundancy package. However, all of her perks will be taken back when she take the redundancy package.

At present she wants to concentrate on her relative that is in the latter state of Alzheimer's and not to have the added pressure of dealing with redundancy just now. She has already had consultations with her manager and each time she has been given different information nothing too major but all the same there was some conflicting information given to her which in the end turned out not to be correct.

Can she asked that they leave the redundancy negotiations off until the end of the unpaid caring leave in April next year. :T

  • Whatever is said..she needs to have it down in writing.

    That way it is much more difficult for someone to try disputing what they did (or didn't) actually say.

    Hi, my understanding is that it is the post not the person that is made redundant, so if the company has already posted notice of redundancies then there should also be a date when those "compulsory" redundancies take place.

    Are you saying that your Aunt has been asked to volunteer for redundancy? if so then she may have more say in matters.

    I always thought that voluntary redundancy packages were usually slightly more favourable than complusory? a lot would depend on whether your Aunt would want redundancy, it would afford her more time with her relative, if not then even deferring til April would not change that.

    I do not know whether being on carers leave affords any other protections in this situations as it would maternity leave?, but unfortunately, if she is on compulsory notice she may not have the option to defer. Most companies want the redundancies finished before their end of financial year, so waiting til April may not be an option for the company.
