Parking Eye

First post ever on a Forum so here goes! Just received a Parking Charge Notice from a company called Parking Eye. All of the details they have are correct and I do not have any ground to lodge an appeal against. I parked somewhere I have parked for the last 20 years to watch a football match and I have never had a problem before but apart from that I am bang to rights. When I first did a quick google search it came up with Parking Eye as a scammer and the advice was just to ignore them. A bit more digging and it got complicated as more recent threads/advice seem to suggest that the rules have changed and they all seem to give advice for those who have been given fines incorrectly. Just wanted a bit of clarity if possible please. If the company is legit and I am legally at fault I will hold my hands up and pay the reduced fine of £60 (rather than the £100 after 14 days). If it is still a scam I will bin it and sweat it out until they leave me alone.
Cheers

Please create your own thread. I have asked a forum guide to split your post from this threadWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Thanks Stroma, the post is now in a new thread.

They may be a legit company (arguably) but their charge is not, have a read of the stickies and appeal to them receive a refusal then appeal to popla and win.0

Time I dusted this off again
You are making the newbies' common mistake which is "I done wrong, guv, so they are right to charge me. How can I defend that??".
Our point is " regardless of the facts, PPCs are penalising motorists to a ludicrous extent to which they are not entitled and we concentrate on helping people based on that point"
Suppose you had been caught doing 35 mph in a 30 mph limit. You get to the Magistrates court and they say "Guilty. Lock him up for 2 years".
You would get a brief to appeal the sentence, not the verdict.
So that's the case here. You are appealing the "sentence" of £100 that does not fit the "crime",
So, you major on the "No genuine pre-estimate of loss" point.
Also, suppose the PPC didn't have the right to charge you 1p as they didn't have a valid contract with the landowner? So you demand that they produce the contract in question that actually specifies that they are allowed to charge you.
Going back to the "crime" of speeding. Suppose that there were no 30mph signs up and it wasn't obvious that you were in built up area. Would that be fair? So you challenge the signage of the park in question. Obviously the signage was inadequate or you would have seen it.
Basically, that's it in a nutshell.
So, was your PCN a windscreen ticket? If not, have you had the Notice to Keeper and if so, date of contravention and date of NtK please.
In addition, please read Coupon-mad's Newbies thread in the stickies at the top of this forum.0 -
Thanks for the posts. I realise that I am being incredibly dim but I have seen several mentions of "read the stickies" - what are stickies??
The parking charge notice was sent through the post not put on windscreen. I live a couple of hours away from this car park so I cant just pop back and see what signage, if any, is put up and to be honest it was dark and because I have always parked there I wasn't looking for signs. If I do appeal on what grounds should I base my appeal on? Finally the letter doesn't say "Notice to Keeper" but goes on about how they got my details from DVLA and it says that I am the registered owner so if I dont let them know that anyone else was driving and give them their details then they will assume it was me and charge me accordingly.0 -
Go to the front page of the parking forum (there's a clue in my signature to tell you where to click from any thread to find your way back there!). Read the threads at the top which have the word 'sticky' on the left of the title (they are the permanent notices for info, 'stuck' up on the board, like on a noticeboard).
Please read the one that was staring you in the face before you ever posted 'newbies read this first!'.
You'll soon get the hang of the forum if you click around, read various threads that catch your eye & always find your way back using that 'breadcrumb trail' at the top.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
