UKPC - Debt recovery plus Ltd

Hey,

I received a parking charge notice on 7 September 2013. My friend lives in Birmingham. She has numerous visitor spaces at her apartment if you display a visitor pass. Unfortunately my pass had blew off onto the floor and I did not realise and I had a ticket on my car when I returned.

The advice I was given off my friends was to ignore all of their letters. However I have now received another letter form debt recovery plus offering "reduced payment offer to avoid court proceedings" They advise this is the last offer before passing it to the solicitor.

I have only just seen this forum which now says to appeal but clearly It's too late for me to do that now.

Has anyone got any idea of what I should do now?

    After reading that thread it seems that because I didn't appeal straight away I have missed the opportunity.

    I'm thinking maybe I should just pay this now if there is any chance they will take this to court

    You would not be much worse off if you lost in court. However the POPLA arguments that win in our POPLA DECISIONS thread win in court too, so you may consider that if you want to fight on.

    You really need to weigh the chances of UKPC taking this to court. Here is the latest information on which PPCs have 'done court' between Oct 2012 and June 2013. You won't find UKPC on it (don't confuse them on the list with UKCPS).

    My guess is that it is very unlikely that you, of all the tickets they issue, would be unlucky enough to become the first and only one to be issued with court papers. And don't forget, that it will more than likely cost them more than the amount of any 'win' they might have at court. So not really good business.

    If you're prepared to deal with a probable string of debt collectors' letters over the next few months ('deal with' means opening the envelope, quick read, file safely, then ignore), then you can ride this out. There's nothing to lose by adopting this strategy, and if (in the very unlikely event of you being their first court case) you don't feel like dealing with that then and paying up, you'd be paying no more than if you sent them a cheque today.

    If it did go to court, there'd be help here and on PePiPoo, and PPCs are now regularly losing court cases.

    If you decide to ride it out, and you need any reassurance along the way, do come back. Whatever you decide to do, good luck.

    That's not what I wrote at all on the newbies thread! Sorry but what you have surmised from it is utter codswallop and not what I advised at all!

    I tell you in the newbies thread that you can:

    - ignore the twaddle, as we all did for years before POPLA existed. (I have my old ignored debt collector letters here and on the newbies thread I posted pictures of some from tospig's vast collection. Did you not see those computerised letters I linked and realise that everyone gets them if they haven't bothered to appeal? So what?)!
    - or robustly respond by letter
    - and always complain to the landowner/retailer/managing agent
    - and complain to the BPA and DVLA if the Notice to Keeper isn't compliant with POFA 2012.

    That's not saying you have no options is it?

    Also your idea to pay these chancers is laughable seeing as UKPC don't ever do court and you would know their track record if you simply search this forum (using the search this forum heading on page one) for the fairly obvious keyword 'UKPC'.

    They've been in court twice...when they were taken there. Please get a grip about this scam.
