Direct debit of my ex

Hi, this is my first post on this forum.
I am divorced now, separated with my ex since Jan 2013. Before separation we had joint account. This account was closed in as soon as he moved out and our bank transferred existing direct debits to our new accounts.
One of them was direct debit for paypal, I can't remember now if I said it was mine ...as we both had our own ebay accounts and own paypal accounts.
Long story short... few days ago I noticed three direct debit transactions from paypal for the total amount of above £500.
I immediately went to my paypal, assuming that my account was hacked.. but that's not the case.
Few hours later I went to my bank and demanded explanation. They checked all history and confirmed that this was direct debit linked my ex paypal. They also checked all transactions related to this direct debit and I ended up paying approx £800 for all his purchases since Jan... . I know I am stupid that I haven't noticed this before, if it wasn't for massive purchases in December.
My bank doesnt accept responsibility for transferring his direct debit to my account and letting paypal charge my account for so long. All they did was filing direct debit dispute with paypal but it just doesn't look good.
Was anybody else in similar situation? How do I get my money back? I am not talking to my ex and asking him to settle the payments is just out of the question.
Any advice? Thanks

Have you now cancelled the DD?
  • Cancelling a DD with Paypal does nothing, as once you buy again using PayPal, the money will come out of your bank again.

You should change your bank account, but don't carry over the PayPal DD.

It won't come out of the bank account if there is no DD authority registered with the bank.
  • Yes its cancelled now and at the same time banks stopped another two payments due to be charged today.

This may be your problem, Unless you can point to the bank having made a mistake in transferring his DD to your account I'm not sure what you can do.
  • Have you asked him to pay?

I doubt it. Either the OP swallows her loss or gets over her reluctance to talk to him.

As the bank appear to have their wires crossed, are your DDs coming from his account?

Is it possible that the ex genuinely hasn't realised that his Paypal purchases are being funded from the wrong bank account? You would think that it's impossible not to notice £800+ of purchases over the course of a year, but the OP didn't notice, so perhaps the ex didn't either? High income and/or financially disorganised?
  • Yes, I won't talk to my ex. He's abusive , at one point police had to get involved. Yes I am also aware that maybe he didn't realize his paypal purchases are funded from my account but as long as they were small payments (most of them at £9, max £25) then it's easy to miss in account statement.

I asked for help because maybe someone knows a little bit more about direct debit regulations. For instance when my car insurance dd was transferred from our joint account , I got a letter from Sheila's Wheels telling me that my bank informed them about changes and I need to tell them if anything is wrong.
Is it possible that paypal informed my ex that direct debit details have changed and asked him to act or not to act?
In this case, he must have been totally aware of what he was doing.
How come banks allow direct debit on my account when its linked to services registered for someone else? My ex surname is even different than mine.
This is the bit I don't understand.
I am considering getting legal help, if this will go to small claims court, would paypal be obliged to give the details of my ex transactions ?
