b goods refund

i bought something advertised as b stock, anyway it developed a fault
and was sent back for a manfacturers repair, item arrived still broke
seller has arranged for pickup, to send again to manfacturer for yet another repair, can i ask for a refund instead of waiting for yet another repair, it say 12 month guarentee etc

No idea what b stock is, but the seller is allowed to make reasonable attempts at a repair. Obviously that failed the first time, a second try is probably acceptable but after that I would be asking for a refund (but bear in mind it may not be a full refund, they may be able to deduct a proportion for the use you have already had).

When did you buy it? If 'acceptance' (as defined by the Sale of Goods Act) has not occurred and the item does not conform to contract then you were entitled to reject for a full refund. Accepting the attempted repair would not be considered acceptance therefore you would still be able to reject the item if it is still broken when they return it.

However if acceptance had already occurred then they are entitled to repair, replace or refund, whichever is cheaper to them.
