Smart Parking

Hi,

My girlfriend lives in a block of flats and there is an unallocated space out the front where I have parked my car for 6 months with no problem.

I have now moved in so I park there more regularly and have got a resident visitor's permit however it wasn't in my window yesterday morning.

I received a Parking Charge Notice for £100 or £50 if I pay in 14 days from Smart Parking, also trading as Town and City Parking.

I was planning to appeal as I have a permit, however this hasn't gone on their online system yet so I'm unable to at present.

However after looking at this site yesterday, I took a look at the signage last night, and noticed that the signage all says Smart Parking Ltd and the PCN says Smart Parking Ltd on it a couple of times.

In addition to this, the Patrol Officer No. filled in his number in that section, and instead of signing it also put his number in there instead of his signature. I wasn't sure if this would affect the validity also?

I just wondered what the best course of action was here, whether to just accept it and pay the £50 within 14 days, appeal it, or just ignore, however I'm conscious that I don't want it to affect my record further down the line.

    do nothing exept read the stickys here until you receive the notice to keeper through the post. Reading the stickys will explain why

    You really do need to read the 'NEWBIES read this first' thread please, as you must wait for the NTK and then appeal as the keeper as long as that's you (do not appeal now, don't give away who the driver was). Smart Parking's NTK letters are not compliant with POFA 2012 anyway so you want to wait for one of those (read other similar threads by searching the forum for the keyword 'Smart'). Your appeal points LATER are stronger than they are now.

    A fake PCN cannot affect your credit rating! This is not a fine. It's an easy-to-beat SCAM.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Will wait for the NTK.
    It's a company car and I don't think it's been changed yet so imagine it will go to the previous driver anyway.

    Plus I'm in Australia from 25th Dec - 22nd Jan so won't be here when it arrives!

    No, in that case, don't wait for the NtK. It will go to the company or their lease company. Even if they haven't caught up with whose company car it is yet, they surely will, and you'll find that, often as not, they'll pay up and slap you with the charge plus a healthy admin fee.

    You must appeal directly to the Notice to Driver. However, you can still keep from them who the driver was. Just appeal as "the Keeper" of the vehicle at the time of the parking incident.

    Also let the company/lease company know that, if they do receive a KtK, NOT to pay, and simply to let you know. (If you appeal now, that shouldn't happen, but it's best to cover your back.)
