Refund policies
Please can anyone advise on wether or not legally a small secondhand clothing agency can state their items are sold as seen, and are unable to give refunds as they are the acting agency not the owner of clothes purchased? Many thanks in advance

If they do state that then avoid them like the plague.
Obviously anything wrong and you are going to have to fight to get your money back.

So if they're acting as an agent....who is it that you are entered into a contract with?
If they are acting in the course of a business and have not made clear that they are the contracting agents of another party (and thus made it clear who you are contracted to).....there is no such thing as sold as seen.
SoGA says that items provided by a business must be of satisfactory quality.

Clothing agencies usually work in the same way that ebay does. People with stuff to sell take it to the dress agency and a price is put on. If it sells, the owner gets £X and the agency gets £X. If it doesn't sell after Y weeks, the owner takes it away again.0

Secondhand clothes may have been shortened for example , so they are not the same dimensions as the original. There is no way the agency can be expected to know about every precise detail of every different used item they sell. Why don't you state the exact problem.

Your statutory rights are not affected.
Normally such a disclaimer is added to any warning to avoid do-gooders with nothing better to do contacting TS about it, but whether it does or doesn't, it still applies
In the event of a claim, you would normally claim against the seller rather than the agent.
Ensure you know the status of the seller (private or business) as that would affect the statutory rights you have.0
