Am I entitled to a refund? And from who?

I purchased a Cosatto Giggle pushchair in July from a local shop called Jollytots. It has since broken twice and has been sent back to Cosatto for repair. Last time I asked them about a refund and they said I had to speak to the people I got it from. So I just sent it back for repair. I got it back 2/12/13 and today (12/12/13) it has broken again, the exact same thing. I phoned Jollytots and they said that they would have to phone Cosatto to see if they would refund them a pushchair before they could refund me my money. Cosatto have said that they will replace the chassis instead of repairing it this time but I'm not happy at all.
Am I entitled to a refund? And if yes who from?


I know have a 4 month old as well as a 3 year old, I don't drive and am without a pushchair for the 3rd time in 3 months (2nd time in a month)

    Under the SOGA (Sale of Goods Act) your right of recourse is with Jollytots.
    What Cosatto have to say to them is not your issue, it's theirs.
    Under SOGA, they have the option to repair/replace/refund, at their discretion. However, this cannot be at significant inconvenience to you.
    I would definitely not be accepting another repair.
    You may have trouble forcing them to refund as they may say a replacement shouldn't have the same issues as yours.
    Can you have a quick Google and find out if it's a common issue? If so, you may have a better argument for a refund.

    There's actually a well-known fault with some early Giggle pushchairs - if you go on the Cosatto website I think you can input your chassis number to find out if it's affected. There's been a lot about it on their Facebook page.

    Whether you want to accept a repair or not is not up to you, they have the right to repair.

    There is, or may be, a new law coming out that after one repair attempt a refund must be given but until then your stuck with a repair.

    That's not true. Any remedy shouldn't cause significant inconvenience as MamaMoo says. I would say being without a pushchair twice already since July and now for a 3rd time I would see that as significantly inconvenient. Unless they can get a replacement frame to you really quickly?
