Letting Agent's Responsibility to Cancel Standing Order

I recently finished a 6 month term renting a property and have just found out through checking my bank account that 1 extra payment has been taken out because the period of the standing order was set to perpetual.

When I started the 6 month rental, I filled in a standing order authority form at the letting agent. Surely, at that point they knew what the end period should be and the SO mandate should have reflected that?

I would like to know where I stand on responsibility to cancel the SO before I phone the letting agent to chase the return of the extra payment.

    Solely your fault, maybe the lettings agent will refund the payment less an admin charge?
  • No. They have no control over your bank account. You could have signed a new contract or it could have gone on to a rolling periodic tenancy. I imagine it's hard enough keeping on top of all the other administrative things ie deposit registration and refunds, deposit queries, actually getting the rent through in the first place. I imagine telling someone to cancel a standing order is probably pretty low down on their list of priorities.
    Sorry, but it's really down to you to organise.

    1) A Standing Order can only be cancelled by the account holder. You.

    2) It is your responsibility to pay rent. And to stop paying rent.

    3) It's your money. Take some responsibility for your own money!

    Now politely contact the agent,explain your mistake, and ask them if they'd mind kindly refunding you.

    only if it is a direct debit does the agent have the responsibility to stop taking payments.

    on the plus side you have reminded me that i need to cancel my standing order for rent before the end of this month, which if i had missed would have left me quite stuffed for money until i got it back.

    Kinda what I expected, that it was up to me to cancel.

    I take it that they do have responsibility to return the money after I have notified them (and I don't really see how an admin charge is appropriate)?

    They also haven't returned my deposit yet.

    Yes they have a responsibility to return the overpaid rent to you.

    I'd love to know why you think they should take the time to search their online banking looking for your errant transaction, incur the bank charges of making a transfer back to you or drawing up a cheque, and confirming those arrangements by written letter (which is entirely appropriate and correct) without recovering their costs?
