HMRC data is not for all and sundry, I'm sure this was mentioned in another thread, of course the information they hold will be important to you and your cause. However the data they hold was not collected to assist with CS or public requirment.

No,but I didn't ask.I was told. The reason I was told is because CMS can and do get income details from hmrc.

I was wondering if something had gone wrong with regard to it (person TOLD me-no asking-that hmrc had no records, this is stated on his computer screen relating to my case,he then said it was strange)

Or whether they hadn't even looked and he was just being a numpty who made me wonder why

Have you seen documentation to support this ?

    Requesting information from HMRC

Our Freedom of Information Act guidance explains how to find information we already publish, and how to make a request to HMRC for information.
If you want personal information we hold about you, you must make your request under the Data Protection Act. This is because there is no right to this kind of information under the Freedom of Information Act.

As mentioned the HMRC is there for the Crown, not for us with domestic disputes.

    A.I have been told.

B.Why would the person even mention it if it was not relevant.

    C. CMS leaflet 'Where do we get this information from- in most cases, the gross annual income figure we use to work out child maintenance comes from information given to UK Revenue & Customs by the paying parent, their employer or a third party such as their accountant.A paying parent, their employer or their accountant can send evidence of gross annual income directly to us if they want'

Because cms operate on 'past years' income, they can (and do) get 'historic' records from hmrc .

Feel free to check with others.

Being told is not good enough as you are discovering.

B.Why would the person even mention it if it was not relevant.

Because it is the type of lines customers want to hear, admittidley you did feel much better after hearing that information.

The part in bold is what you may have missed, it doesn't say they CMS/A will fetch the information, that information is protected under the data protection act and freedom of information act.
I know it's not what you want to read, but your post count suggests you have visited the board long enough to be aware of years long cases and frustrations of some PWC's trying to get a fair assesment from the NRP's.

Then I suggest you read the info.

They do collect from hmrc. The last bit was in the paragraph saying 'what if I don't believe the information is correct' bit.

I am fully aware of frustrations. He used to pay,we got back together,he ran off, abandoned son,had to pay 420 a month, had a baby played the system, nil assessment, his gf claiming they couldn't afford their child and blamed me not their trips, holidays, treats, saving for wedding and divorce etc then decide they can afford 800 a month house (200 leap) and surprise surprise,he's sendingbizarre letters to cms and expecting another baby!

The past 2 years, well it's less than that, has been a bloody nightmare with all the game playing and csa.Wish it was just as simple as just the csa.

Anyway, that was a Fed up rant, sorry,I need money to fund my disabled sons care after it was taken away due to him being 'too complex'.

Wondering f hmrc info could be due to him buying the business he worked at halfway through the last tax year?

Sorry for the rant,I'm tired and fed up:o

I understand you are fed up and you have the right to rant, my replies are not to attack you or wind you up, whether PWC or NRP, one should always be sceptical about what those on the other end of the phone are telling you, after all they could have just got on and obtained the information required to process the claim in a swift and timely manner.
  • On the 2012 system, CMS attempt to get all income details directly from HMRC. About 90% of cases have this information available. CMS get this information when the case is first opened, before speaking to the paying parent (NRP in old terminology).

If they couldn't get this info, it may be because his last tax return wasn't for a full year. In this situation they would ask him to provide income details, if he doesn't do this then they'll go direct to his employer (like they do on CS2 cases).

The 2012 scheme was developed in full conjunction with HMRC - there's a direct interface between HMRC and CMS to gather income details within 30 seconds or so.

Thanks :) Shame they couldn't tell me that!

He bought the business in october last year,so wouldn't have had a full years tax return. So I guess it's down to him to provide that along with the details of his other job.

    Makes sense now!
