ASDA Smart parking fine 4th/5th letter!!HELP

Hi All,

I parked in an asda car park and stayed 15 mins over my allotted time as it took ages to park and I had a big shop to do.

I have had a number of letters from smart parking which have all gone to another address so only opened them recently.
I think I am on my 4th/5th and am terrified they will take me to court!?

I have read just about every single thread on here which all told me to ignore it they wont take any legal action but the letters are looking fairly serious now...the fine is at £200 and something pounds.

There have been no recent posts giving advice on what to do in this situation...Any help would be greatly appreciated ASAP.

Thanks

    Unbelievable!

No one has said to ignore for a very long time indeed.

Go back to the home page and look at the info in red, at the top regards changes over a year ago

Then read the sticky that says NEWBIES - READ THIS FIRST.

Then I can only suggest that you look again and only read posts less than 6 to 8 months old.

Please read them and then ask again if you still don't know what to do next.

    Question - Which ASDA?

In Scotland or Northern Ireland? Or England & Wales?

Now I for one find that statement of yours annoying. I spent hours writing the 'newbies read this first!' thread and NO-ONE has said to ignore these tickets for many months. I am almost minded not to bother to help but am trying to keep to the 'be nice to all moneysavers' rule. Your post makes no sense at all though.

With respect, what are you talking about? Every single thread on here for the last 4 or 5 MONTHS has said to appeal. Couldn't you find page one of the forum?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:
Home»Motoring»Parking Tickets Fines & Parking - read the NEWBIES THREAD
  • Assuming this goes to court - unlikely - and you can produce your shopping receipt or bank statement, then what judge is going to award to the claimant for losses incurred at a FREE supermarket car park? What losses? A day out at court with all expenses paid (meal allowance, travel, loss of earnings etc) would just suit me fine.

A naive assumption based on forlorn hope and in the face of lots of experience on here.

People do win in court, but not for the reasons you suggest. Since when does spending lots of money for food etc invalidate a contract, which is the argument PPCs use.

Please do take some time to read some recent threads on here to gain a decent grasp of this whole area.

You will also find out the difference between cases in Scotland and the England/Wales.

Ignoring is however still a very statistically proven tactic.
They are other ways, like costing them a few quid, but as statistics go, they are well in your favour and now you have no choice.
Even if they do try court, which is very rare, as of late most PPC that have run up against robust contractual penalty defences have lost.
    Be happy...;)

Here are your chances of being taken to court. Check out for Smart Parking, or their previous name of Town and Country.

Let me know how many times they've 'done court'. What do you think your chances are now?

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
