Completion date delayed due to solicitors!

Hi all,

I am absolutely at my limit today. I was supposed to complete on my first house yesterday and was told that this couldn't be done due to this reason:

The solicitor has changed address in the past couple of months and not registered with the panel the new address. The mortgage company is now refusing to release my funds as the information from the solicitors isn't correct (rightly so too! Glad they are checking where my mortgage is being sent!) and the update to their systems could take 3 - 5 workings days.
The mortgage company is also now re-evaluating my mortgage (can they do this?) and I'm worried that the amount could be different than the previous offer.
I don't know where I stand. I have taken time off work this week to move and have moving vans etc booked for Saturday - I wanted to clean the house top to bottom first.
Am I able to complain to the solicitors and get some kind of compensation?


Any advice would be gratefully received as I'm just sat at home, refreshing my emails and hoping for some good news....

    That's awful! Can't offer you any advice but hope it all gets sorted soon.
  • Have you exchanged?
  • Unfortunately no. I have been calling the solicitors every day for the past 3 weeks and have been given the run around constantly. I have been asking to exchange but have been given every reason under the sun why we can't. My favourite was "We can't exchange until you have your deposit money.". This was fine as it has been in my bank account for months so I asked for the bank details to send it to. I was then told they couldn't provide me with those until they had written a financial statement. It's taken them 2 and a half weeks to provide me with that!
    I have had to change solicitors within the same firm (too late to switch firms completely) as the original people dealing with my case hadn't done anything. The new solicitor has been fantastic and has picked up the case quickly.She is also appalled at the lack of progress on my case over 3 months considering it's a no chain purchase and the vendor has no chain either. She is going to exchange and complete on the same day (hopefully today!) which is not the way I wanted it but have no choice now.


    I just had a call from my mortgage broker saying that the address has been updated and we are hoping my solicitors send back the COT before half 12 so we can get the funds released on the same day......

    The next 45 minutes are going to be awful! :eek:

    I'd be putting in a complaint to the Legal Ombudsman
    I work in the 'moving industry'. My frame of reference is around 20 years and circa 27,000 domestic moves.

    It's frustrating, but people rarely exchange on the first suggested date. They often change.

    Absolutely no point in putting in complaints as you've not exchanged.

    Harsh, but that's the way it is. They could even decide they're no longer selling and you'd not have a leg to stand on and wouldn't be able to claim a penny.

    Yes, the mortgage co can do what they like until you've exchanged.

    Never book anything for definite until you've exchanged.

    Agreed. I originally thought the OP had exchanged the way the completion was mentioned.

    House buying requires patience and then some!
  • I wish I could have exchanged, I have tried everything I can to do so! 10 minutes before the cut off for today..... Please please please let this go through!

    I can see you getting itchy feet in 6 months and doing it all again ;)
