PCN - Sefton Council

I received a PCN from Sefton council in the car park of Southport Theatre, and have unsucessfully appealed. They claim, despite the evidence that I purchased a valid ticket that it was not clearly on display. Once I returned to the car and opened the door, the wind caught the ticket so I have no way to verify this. Apart from the inhumanity of waiting until 10 mins before a major event goes ahead (which they would have known about) I have a few questions. I presume they need/have photographic evidence of the alleged contravention, as their email in response to my e-mail only states "It has been noted face down in your vehicle". Is this sufficient?
Secondly their PCN contains an error in that they claim my vehicle is silver. It isn't. What route would you propose? I have only received the e-mail rejecting my appeal today, so at present have 14 days to pay the reduced rate charge.

Carry on appealing and send a ''Bogsy special'', which you can ask for on the pepipoo forum:

Bogsy is a regular poster there and he has a brilliantly worded appeal for 'fluttering ticket' cases like yours.
In the meantime email or phone or pop into the Council offices this side of Christmas and get a copy of the Traffic Order for that place. It's you right to see an Order as it's the public document which creates the restrictions. Get that up front now while you await the Notice to Owner. Maybe check the Council website first though as some Councils have their Orders linked on their website. You'd then be looking for the pages which relate to any restrictions at that exact place and whether it says a driver has to 'continuously display' a P&D ticket. If it doesn't, then the contravention did not occur. Even if it does say a driver has to continuously display a P&D ticket you still have grounds to continue appealing.
Start a new topic on pepipoo, only with pics of all documents, including the right page(s) of the Order which relate to that exact bay/road/car park and including the front & back of the PCN (all small print). Almost everyone on that forum wins on appeal but you have to take it further and forget the discount. A leap of faith with the odds in your favour!PRIVATE 'PCN'?
