I know that this has been answered but i was hoping for some clarification.
Our tenancy started on 7th November 2009 and ran for 2 years ending on 6th November 2011. Since then we have been on a SPT.
Recently we bought our own place (yay!) so wrote to the LL via the address fro serving notices on our tenancy agreement. The letter was hand delivered on 26th November.
I put in the letter that we were giving ONE months notice and would be returning the keys on 6th January. The FIXED tenancy agreement said we had to give 2 months notice but after doing research on this lovely site I knew we only had to give ONE month notice.
The LA have written back to us to say they will be collecting the keys and doing a final inspection on 28th JANUARY. It seems to me they are counting the 2 months notice from when we handed the letter in and not from the tenancy period.
I am very confused so could someone please tell me who is right?
We have phoned them and they've said to put in writing that we are contesting the 2 months notice.
Can't wait to be rid of that place and all the problems we've had over the last 4 years!!!!

Dear Mr landlord,
Further to my letter of 26/11/13, I am writing now to clarify the date the tenancy willend.
I am currently on a Statutory Periodic Tenancy (as created by the Housing Act 2004), with tenancy periods running from 7th to 6th of each month.
As confirmed by the Court of Appeal in the case of Laine and Mitchell v Cadwallader & Cadwallader (2001) , I am required to give one full tenancy period notice.
In my case, this runs from 7th December 2013 to 6th January 2014, on which date I shall vacate and the tenancy will end.
I would appreciate your cooperation in collecting the keys on that date, and completing the check-out process. If this does not prove convenient to you,I shall deliver the keys to your agent's office.

Did you pay a deposit ?
Has the Landlord registered the deposit in the DPS and provided all the info required by Law ?
You have lived in the property for over 4 years so " Fair wear and tear" should be taken into account.
Did the Landlord or letting agent provide a good check in inventory which you signed ?

Yes Dimbo we did pay a deposit which is protected. I seem to remember signing a check in inventory when we moved in.
