UKCPS and Disabled spots

I've been reading through the masses of information here and I'm hoping you can help.

My grandad received a ticket for parking in a disabled bay without displaying a badge. It's private land, the ticket was issued by UKCPS.

He is a disabled badge holder, he'd left it on the dash BUT forgotten to open it to display it.

Anyway, I followed the advice, wrote a letter of appeal from the template provided. I included his disabled badge number as evidence that he is, in fact, disabled.

They received a response....

"Disabled bays are provided for the use of motorists who display a valid disabled badge clearly in the windscreen of their vehicle. This parking restriction is clearly stated on numerous signs at the car park which state the badge should be displayed with all appropriate details clearly visible for checking purposes. Prior to leaving the vehicle it is the responsibility of the motorist to ensure the Disabled Badge is clearly on display and not dislodged. By parking the vehicle in a disabled bay the driver contractually agrees to display a valid disabled badge or pay a parking charge of £100 (reduced to £60 for early settlement if paid with 14 days from the day of original ticket issue), which remains unpaid. Whilst we symapthise with the situation, the parking charge was correctly issued.

"Please see photos to show that disabled badge was not displayed correctly and this is reason ticket was issued.

"UKCPS can only address the factual issues of where and how you parked. We will not enter into discussions about the legality of parking on private land or of the landowners right to impose parking conditions on their property. We have considered everything stated in your correspondence but it does not contain grounds to uphold your appeal. If you wish to make further representation, with additional evidence, please provide this within seven days of this letter. Second appeals must contain additional reasons not contained within your initial representation which you wish us to consider. You may also appeal to an independent assessor through POPLA details of which will be sent at the appropriate time if requested."


Following the advice on the forum, I'm going to draft a letter to Wetherspoons (where my grandparents were visiting) and pop to the car park to check out signs etc.

Has anyone any advice on appropriate responses to the letter? Any other pointers?

    Yes
    Simply write back tell them you have nothing further to add and that you require a popla code by return.

    Nothing else. Don't waste your time looking at signage , urs irrelevent in beating ukcps at popla. We can help you sort out a winning popla appeal.
    But do complain to weatherspoons.

    Good post bk with your popla draft. Ukcps are a horrible bunch with offices in portacabins behind a pub,

    A good strong letter to weatherspoons might give u sone vouchers as they can be pretty good

    Not at all - KIL is pointing out what a set of Arthur Daley's UKCPS are. An ex-employee had to get High Court Sheriffs involved to collect a debt from UKCPS - it was telling watching the rats scurry away and hide.

    Tell them that they are in breach of the Equality Act 2010 for not making a reasonable adjustment, this is primary legislation not a poxy term in a car park. Have you made complaints to the retailer involved? They are equally liable for a breach for the actions of their agents.

    I would also photocopy the badge to both, and ensure that you are supplying a copy out of courtesy as the blue badge scheme does not apply on private land.
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    They are going to complain to weatherspoons who have a decent record when it comes to customer complaints tbh

    Yes, I'll be writing a letter to Wetherspoons after reading the advice on here (I have the receipts and so on). I'll get my grandad to bob in with his badge so I'll take a copy.

    The original appeal letter did contain information about the Equality Act, the disabled badges on private land and so on - although I understand UKCPS are not the "nicest" of companies I was hoping to just get it sorted quickly because my grandparents are falling for the scare tactics! I used this link for reference. I think that's why they included the bit about legal discussions? Although when my grandma read that out over the phone I have to say I got angry! How can you enforce a contract without legal discussions?

    I got a ukcps ticket at the weekend for not displaying my blue badge in a disabled bay, I was wondering if I appeal it will it go up to £100 or will it stay at £60?
