CP Plus charge notice on company car.

Evening everyone. Just recieved an email from work regarding a charge notice from CP Plus for an overstay of an hour at a Moto services (my work are the registered keeper of the vehicle). I understand that I need to appeal against this via soft appeal/ POPLA but can I inform them myself that I was in possession of the vehicle at the time or does my work have to inform them that I was the driver so the can then issue me personally a parking charge??? Thanks in advance, Dan

  • I've recently been in a very similar situation -
    company car, MOTO site and same PPC.
    If you want to get the company 'out of the loop', tell the PPC that you were the driver is the advice I got.
    Then appeal against it and ask on here for advice - there are a lot of helpful folk to assist you.

    Well from the company's point of view the right answer for them is:

    - they should write and give the name and address of the driver allocated this vehicle. The reason for them having that as a policy is that they are then not liable at all under any circumstances, under POFA 2012 they will have discharged any potential liability immediately. If they have a lax policy and let drivers deal with these routinely, then they leave themselves open to a driver ignoring it and then the PPC scumbags can revert to the company as liable, under the POFA 2012. The company could even be sued if the PPC was litigious, like ParkingEye, so you can see why it's important for them to get it right!

    From your point of view, it doesn't matter which way you approach this but if it were me I would write now saying this is your car, and making an appeal about the unclear high signage, no ownership of the car park and no genuine pre-estimate of loss. I would do it sooner rather than later because then you can be sure that the PPC cannot continue to write to your company at all (as soon as they know who was driving they have to focus on you alone).

    Out of interest did they send the postal PCN to arrive at your company within 15 days of the parking event, and does the ticket mention POFA 2012 or keeper liability anywhere?

  • Thank you for your replies. In answer to your questions, yes, received the PCN today, 10 days after the event. No mention in the letter of PoFa 2012 or registered keeper liability. I've sent an email to our company car dept. asking them to confirm to CP Plus that i was the driver of the vehicle at the time of the event. I shall email CP Plus tomorrow informing them the same thing and include an appeal. Thank you again, I'm sure I'll be back for more advice soon!

    You could also try a quick phone call to the Manager of that MOTO Services to see if he/she can extend the season of goodwill to cancel your ticket. The ''Successful complaints about PPCs'' thread near the top, shows you in multiple example threads, that regional Motorway Services Managers DO exactly that, quite often when asked!

    Personally I would actually say you were the driver, because you should be able to win it at POPLA anyway (with forum wording) and they'll have no room to try to contact the company at all if they know the driver for sure.
