Thomson Holiday transfer of holiday

Hi - any advice please, we booked a holiday for February 2014, unfortunately we need to cancel this holiday and transfer to another later on in the year.
We have paid both deposits totaling £350 for the February 2014 holiday, the issue is we booked a Royal Caribbean Cruise for October 2014 with them but they say that the deposit we have paid has to be transferred to another Thomson holiday and cannot be used on the Cruise. They are now putting on pressure to book another Thomson holiday which has to be taken before the end of March 2015. Which due to our current commitments we do not wish to do, we have also asked if the money can be stored in a holding account until we are in a position to re-book another holiday again they say this is not possible.
If we do not re-book another holiday by the end of Thursday evening they have said we will loose our deposit.
Any clarity on what our rights are would be appreciated before I go back to Thomson on Thursday

Your rights will be detailed in the contract you signed/ were given a copy of when you purchased the holiday. What does it say?0

Yes, receipt of the terms and conditions by email (and you not signalling disagreement), or ticking a box to say you have read them online, will be sufficient. How did you book?0 -
We booked over the phone with a Thomson sales rep from the superstore, what disappoints me the most is having to transfer to another Thomson holiday and not one of our choice that they have still booked but looking at the terms I can only assume that the Royal Caribbean is not part of the TUI travel group company as it states if they were to cancel they would find an alternative from this group.0

Royal Caribbean is nothing to do with Thomsons, completely different companies. If you have to cancel is it an insurable reason can you claim off that. To be honest most companies wouldn't let you transfer, you would just lose your deposit.0

In a shoot out with Thomson and an RC cruise, I rate Thomson and their ships higher, but to your problem.
Once the booking is complete and the deposit paid (assuming the full deposit and not a low deposit promotion) you are obliged to perform (ie complete) the booking or forfeit the entire amount paid. They are offering you a waiver to prevent a loss, but there's a quid pro quo - you use it to book a Thompson holiday, or if a cruise - one of theirs.
Faced with not losing your deposit - you either take up their reasonable offer, or forego it - it can only be your choice. If you do not wish to be bound to terms, you do a last minute booking and and win or lose based on availability. You have no rights to force them to return your deposit, especially this close to a sail date - and where the full amount is almost due.0 -
