Help Rejecting a £40 parking charge in Asda

Hello
I received a Parking Charge Notification (PCN) today and I need help wording my appeal to reject the PCN.
The Private Parking Company (PPC) say my car was parked in an Asda car park for a little over the time limit for free parking. They say my car was there on the 25th of November (no ticket was given on the day). I received a PCN letter through the post today (the 10th of December).

I have read the PoFA document and it seems that the letter had to be delivered by the 9th of December – 14 days beginning after they say I broke the parking rules.
The letter they sent is dated Friday the 6th of December and according to PoFA a letter will be presumed delivered/”given” 2 working days after postage which is Tuesday the 10th and that is when it was delivered.
Assuming I’ve worked out the dates correctly..
How do I word my appeal when I get in touch with the PCC so that they won’t bother me anymore?
Thank you

  • Who was the PPC?

Dont worry about how you word your appeal, as if they reject you can with our help win @ Popla and that will end it for you.

Don't waste time on your appeal to Not-so-Smart, they've already decided they're going to reject it even before you've written it. Just make sure that at the bottom of your appeal you include something along the lines of "when you reject my appeal please be sure to provide me with a POPLA code". When you get your POPLA code that's the appeal you'll need help with. Have a read of this thread to get an idea of the process - https://forums.moneysavingexpert.com/discussion/4488337

Also make sure you complain to the store manager at Asda and don't believe him/her when he/she says Asda don't own the car park and/or there's nothing he/she can do.
The fridge is empty, the walls are damp, there's no hot water

  • Dear Not-so-Smart Parking,

This is the Registered Keepers appeal against charge ref xxxxx.

The Registered Keeper doesn't believe that the charge reflects the losses incurred by the landowner and that Smart Parking has no contract with the landowner to enable you to issue said charge. The charge is therefore invalid and should be cancelled immediately. If you do not cancel the charge then you should forward a POPLA code within 35 days.

    Signed,

  • I haven't complained at ASDA yet. That was going to be my first option until I noticed that smart parking had messed up the dates after reading the thread kirkby posted.
So I am right to contest the charge then?

    YES!

then come back here when you get a popla code if they reject it

  • Okay, I'll let you know how I get on. I'll put dates etc in my appeal to see if it makes any difference
