Parking spaces to be retained by the owner

  • Hi everyone- my boyfriend just spoke to the seller- he said he will update the plan to include the parking space with out plot, and will put in writing the plan to divest ownership of the communal area in favour of the three new owners of the houses. Our solicitor has spoken to them about it and is happy.

    I'd worry that they were being petitioned for bankruptcy as well.

    It could be nothing though. If a company doesn't make the annual return of just confirming who the directors are etc. in time, they move to do this.
    Everything that is supposed to be in heaven is already here on earth.

  • If the spaces aren't in your plans, you won't be the owner and, therefore, will never be able to stop anyone from using these. Especially when they are earmarked as communal! Communal means just that: anyone living there can use them. In some areas, I've seen owners struggling to stop people from parking in spots clearly marked with their property numbers, let alone those that they don't own. I'd say: either get it all nailed down and don't proceed until it's done or have the price reduced to suit if there are alternative arrangements for parking.

    The solicitor received confirmation today that the striking off proceedings had been suspended-it looks like Doozergirl was on the right lines as it was started due to a delay in submitting accounts.

    I will make sure all the ts are crossed and is are dotted on this one, thanks all very much for your responses.

    I am in a small new build development of 5 properties and the builder went bust very soon after we moved in and before the last two houses were sold. We had a couple of big build problems which were very difficult to get fixed due to the bankruptcy. Two of the subcontractors wanted several thousand upfront before they would put right various works. This was money owed by the developer. Walk away op, cut your losses and get out. The set up you are looking at appears very dodgy indeed

    ps, all is fixed and sorted now but we had to lay several thousand on the line which we eventually got back one way or another plus the fact that zurich were the insurers and were brilliant. Nhbc would likely not have covered

    There was no whiff at all of bankruptcy, it happened very suddenly. The plug was pulled
