    No, I assume he bought the instrument from post-tax income, just ask him for the hand-written one.
  • cheers, will do. thats all i really wanted to know. obviously if it were the case that something came up, would he have been expected to pay tax on something like that. As long as i can tell him it's just for my business and to cover myself he got nothing to worry about, ( or put the price up)
  • My take on this :

    HMRC do not actually need to see a receipt. You could include a copy of the advert in your accounts (HMRC will only see it if they audit your accounts, and I personally think if you note the name and address of the person, plus how much you paid then the HMRC are unlikely to be phased). I think the term is petty cash?


    However, if a person is unwilling to put their name, and address and signature on a peice of paper stating that said item (with serial numbers) is theirs to sell, but is sold with no warranty and sold as seen, then you have to question the motive. Can they prove provence ? In this case the proving of provence is not an issue as he has the original receipt.
    I would want a receipt so that if the police came knocking, there was no potential for being charged with handling stolen goods.

    You say he bought it in a personal capacity in which case there is no tax for him to pay, he is just liquidating one of his assets.

    You do not have to be in business to request a receipt or to write a receipt. Even with private to private transactions asking for a receipt is perfectly acceptable. In this case it is private to business. I cannot see the problem. When antique dealers buy from a person they often ask for receipts. This is the same situation as far as I can see.

    However, since you ask, and no I have no proof either way, but it certainly wouldn't surprise me if this gumtree seller did indeed regularly sell such items ;)
