Pofa 2012

Hi there,

Does anyone know if a parking ticket offence occured before POFA 2012 - is the keeper legally obliged to divulge who the driver was ?

  • On the assumption you're talking about a private ticket then there is no legal obligation to say who the driver was NOW let alone pre-POFA.

  • Hi there,

    This has gone to the county court already - the solicitors have requested some details following the original submission of defence.

    Essentially my mother was ticketed on two occasions at a hospital car park when I used her car as mine was in for repair. The offences were dated back in April 2012, before POFA.

    Alongside the genuine pre-estimates of loss routes and lack of contract we have stated that she was not the driver of the vehicle and that there is evidence to prove this. Our evidence is the witness statement which we do not want to divulge until the court date or at least when requested by the court.

    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    Both cases were allocated and given court dates in April at Guildford County Court.
