Redundancy payment shortfall

I was made redundant last week after the company I worked at for 25 years went into administration.
Because the company went into administration I only get 12 weeks redundancy instead of the max 20 weeks.
Can I claim the rest (8 weeks) as a preferential creditor ?

    There are two payments due, notice(max 12 weeks) and redundancy(max 20 weeks) don't get them mixed up.
  • Because the business went into administration I get 12 weeks redundancy from the Government instead of 20 weeks from my employer. I don't qualify for 12 weeks notice pay as I found another job and the Government deduct any wages from the notice pay.
    I know my ex employer has assets so can I claim the 8 weeks shortfall from them as a preferential creditor ?

    Are you sure these are not under a different companies name?

    You really need to get proper advice on this because what you think you know might not be what you actually know.
    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked
  • Who has told you that you are only entitled to 12 weeks redundancy?

    When my company went into administration, an employee with 18 years service received the full redundancy they were due. It was more than 18 weeks pay due to them being over 40 and the years worked after 40 counting as 1.5 years.
