    What does a 'site manager' have to do with it, and how are they responsible?

    Do you mean the management company of a block of flats, or something different?
    Retired in 2015.

  • Yes the management company who own the block of flats. They renovated the whole building and rented out the flats, while slowly selling off the flats. They were the previous landlords to the tenants

    OK, begins to make sense as to why they gave you a flat.

    Tomorrow, straight down to your solicitor and explain. You probably cannot back out of the transaction, but it is worth a try to have the transaction reversed until they can give you vacant possession.

    It makes me wonder why they didn't give the tenants the vacant flat so you could move into the one you'd bought instead of moving you into the vacant one.


    Agree with all that's been said. You need proper legal advice on how to proceed so you don't land yourself in the !!!!.

    Hi I've recently brought a flat. On Friday I went to pick the keys up to finally move in to find someone was living there. I was told the property would be vacated. The site manager has given me another flat to move into for the time being. Am I due any compensation
    Now, Daniel, tell us who was in the flat when you viewed it? Was it vacant or was it lived in? Was it the same people who were there when you went to take possession?

    And finally, are you a first year Law student?

  • Agree 100% sandsni, they should have vacated the current tenants long ago.

    Van healer - I'm not a law student. I viewed the property 3 months ago, then I said I would take it, it's the same tenants from three months ago. The estate agents assured me thy would be vacated by the time I was meant to move in. I get there Friday and they are still there. This was the first they heard about having to vacate the property.

    This doesn't sound like a "usual situation". It'll probably be OK and the tenant will move to a different flat at short notice; who knows, maybe he kind of agreed to do that when he moved in. It will be a pain for him as services will need to be changed from one address to another.

    This is a c0ck up by the managers of the block of flats. It is also a c0ck up of your solicitor if he knew there was somebody in there. Not sure who to point the finger at. Sort it out first, then worry about who to point at to blame.

  • I think the site management are willing to compensate him and me for the c0ck up. They even asked me how I can be compensated. I think the tenant will be willing to move flats if the site managers give him a months rent free. I'm just concerned whether he has a change of heart.

    Don't be too eager to settle. You will now need a lawyer to scrutinise the end of the tenancy and resolve all issues to do with the tenants deposit for example. There are potentially quite a few costs you could not easily identify.

    But surely the sellers have failed to complete as per the contract terms and are therefore in breach of contract. If the ownership of the flat has not yet passed to the OP, how can he take on the mantle of landlord?

    I suspect that the mortgage company might blow a gasket if they discover that their money has been paid over but no property has 'arrived' to cover the monies. I wonder too if there is an implied obligation for the OP to inform the mortgagors of what has happened.

    OP - don't be too quick to settle. I suspect that heads may roll, very expensively, before this is all over. Good luck in sorting it all out.
