Online purchases: rights for returns

After buying some curtains online from The Range. Unfortunately, when we got them we have realised that they are not quite the colour we thought they were and they don't go with our new d!cor. I wish to return them, but when trying to get them back into the (CHEAP!) packaging, the packaging has all torn. It really didn't take much for it to break.
On the website, it says that returns must be sent back in a re-saleable condition in the original packaging.
Does anyone know where I stand on this?
Would I be right to say that if I have to send it back in the original packaging then it is THEIR responsibility to make sure that the packaging is of a good enough quality to be able to use again?
Thanks
Brendan

If you are within 7 working days of receiving the item, you can return under the DSRs, which explicitly state that goods do not need to be in the original packaging for a full refund.0

DSRs = Distance Selling Regulations.
Have a read of MSE's Consumer Rights guide for an overview.
For more detail, have a look at the OFT's guide to the DSRs.0 -
Distance selling regulations. If you're within 7 days you can return them as long as you haven't trashed them. The packaging being turn doesn't matter.0

As far as the regulations are concerned, it doesn't matter if you have totally trashed the goods or even failed to return them. Once you have followed the correct procedure for informing the retailer of your wish to cancel the contract iaw the regulations, they should refund you within 30 days and this refund can't legally be withheld due to the goods being returned damaged or not returned at all.
In reality though, I can't see many retailers agreeing to refund if they received back damaged goods.0 -
Can I return them to the store? or do I have to post them back? Obviously it would save me on postage.0

You have to send them back - http://www.therange.co.uk/fcp/content/delivery_and_returns/contentPLEASE NOTE that unfortunately you are not able to return or exchange your online order in store, if you have any queries regarding an online return please contact us at webcustomerservice@therange.co.uk
There is no law that requires online stores to offer in store returns.0
