CCJ removed of my files/ set aside... now what shall I do?

Last week I had a court hearing and had succesfully had my ccj REMOVED of my account (set aside). Judge also said he will cancel the orginal order , as if to say there was none at all, cus I have paid the money off.

Anyways how long does the whole process take for it to completely? to remove of my file? Do I need to contact the credit reference agencies to inform them of this? or will the court do this?

  • Hi - how long did it take from submission of application to decision? Did you use a lawyer? I have just checked my credit files and exquifax has placed a ccj on my file (which is also on public registrar) dated 7th Nov but I have just found out. The address was linked to 101 where I live at 104.

    Firstly, I applied for it to be set aside End of October and I got a hearing 6 weeks later. but it all depends on the court, how busy they are. So i suggest you ring them to find out the waiting timescales.
    I read your post in relation to how you have been left with a CCJ. Your case is easy peasy. The fact you never recieved the letter cus they sent to the wrong address is enough for you to get your ccj set aside. Also it's the banks fault as they made an error which meant you had a debt that doesnt belong to you ( as I understand your situation).

    My advice to you:
    1) Ring the bank a few times in relation to it ( just so it's on record).
    2) Write to the complaints team. You deffo should do this. These guys are more trained in dealing with situations like this and are more sympathetic. Request them to write you a letter explaining the 'error' and it shouldn't have been there. Also that you have been in constant contact with them to rectify the issue .

    3) You don't need a lawyer (dont waste your cash). It's VERY informal. Just know the facts, when the judge asks you questions. ( again very informal).

    Just to give you some confidence. Most people thought my appeal wasn't worth doing as it will be unsuccessful. My CCJ was placed on my account in 2010! and I recieved the court letter at my address and failed to act upon it within a month. In addition the debt was owed in 2006!! (wrongly ofcourse)

    The fact that you never recieved your Court papers to the correct adress is sufficient to get it aside itself, if you have no debt with the bank or pay it off. If you have the bank sympathising with you, it will Greatly Help.

    The court should change the register that then goes to the CRAs. Think it can take several weeks to update.
