NHS labs merging but not the trusts.

Hi All.

I work in an NHS laboratory, initially the trust I work in and a neighbouring trust had planned to merge but this has been shelved.

The labs however are still planning to become one entity.

The current plan is for all the staff at the other trust to be TUPE'd over to us and then competitive interviews will be held if there is an excess of staff at a given grade.

I am wondering if this is legal, can a trust TUPE in staff that it knows are in excess to its needs and then force staff to compete for jobs they already have ?

    It's often done in private firms.

    Yes they can - have been in that situation in the NHS. There was competition for some posts and other employees were slotted into a new structure.
