I'm sure ILW (I Love Winking) will be along here shortly :rotfl:
Anyone seen him lately?

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Getting back to the serious side of things - and I have commented on this before - but who or what the hell is H&S and in what capacity do they purport to act?
H&S Litigation do not employ a solicitor
H&S Litigation are not registered with the Law Society
H&S Litigation are not registered with the Solicitors Regulation Authority as an alternative business structure
H&S Litigation do not have a Consumer Credit Act licence and are not, therefore, registered as a debt collector
So what is it that they do? The implication is that they advise ANPR from a legal point of view but judging by the wording on the so-called claim form I can't imagine anybody with any degree of legal training willingly associating themselves with that.My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).
For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com0 -

Except if you look at their website they unlike the others seem to be touting for business, which as we know would be illegal without a licence.0

Apart from all the lies (e.g. once court case file, there's no turning back), it's nice to see that they admit that the signage is there to deter parking contrary to the landowners wishes. This clearly makes the parking charge a deterrent rather than a sensible amount, and thus it is unenforceable.0

Luckily POPLA agree. However, we have yet to see what IPC decide with their appeals.
Courts are a lottery as we know, so no point is second guessing them.
As long as Joe Public think of these private charges as fines and cough up, the " industry " continues. But the word is spreading - just look at the increase in cases on here - and the number of challenges they will face will increase, as will the pressure on supermarkets and retail parks when genuine customers bite back.0 -
Sadly despite all Trevors dodgy practices there are very few complaints made against him. The DVLA have only received 3 and passed them straight back to the BPA who did nothing.
In fact the BPA said it is ok for Trev to have a 2 stage appeal system despite the code of practice saying a POPLA code should be included in the initial rejection letter. Seems they have a strange definition of "initial" at BPA towers.0
