After Debt Relief Order

Hi All
Can anyone please help. Due to cancer I had no option but to do a Debt Relief Order. I was discharged in August 2012.
I still get emails from Nat West credit card saying my statement is now ready and for my Nat west bank account. Also others are updating my credit file as if the account is still open. There credit companies was included in my Debt Relief Order.
Is this normal?

and help would be great
Thanks

They need to mark you credit file as settled as per the discharge date of your DRO, and the default date no later than the start date of the DRO,

You follow much the same procedure as in this link.

----> Credit Reference File Clean Up Post Bankruptcy

The principles on correcting the files are the same.

Except that you need to modify the letter to suit a DRO.

For example like the one here ---> https://forums.moneysavingexpert.com/discussion/comment/44051186#Comment_44051186

Can the credit companies still carry on updating my credit file each month

Depends what they are updating with and where it says settled or not?

If defaulted and settled, some of the CRAs used to keep updating with an 8 each month until it finally dropped off. That was just a quirk of how they displayed the account though, and not a big deal.

However, if it is not marked in some way to show it is settled and they are continuing to update with an outstanding balance, then THAT is wrong.

The should have the default date as July 2011 and say "satisfied" with satisfaction date of July 2012.

You need to write demand they be corrected as per my earlier post.

  • ok
    Thankyou Very Much
  • Is it ok to post in this topic for questions about a DRO?

I have terminal liver disease and I am unemployed, went for more than a year using up all my savings paying monthly loan payments until had nothing left, so I was forced to get a DRO, up to the DRO I had no missed payments, the last one they took wiped out my housing benefit payment and left me £5 short of my overdraft limit.

Despite the DRO having been granted on the 26th November, I have been getting notifications from Barclays and Lloyds telling me I have to setup direct debits to repay loan/credit cards.

The most recent letter from Lloyds reads

"We have reviewed your account and see that you are behind on your payments.

Please contact us urgently on the number above so we can discussion the options available to you and how we can assist (0845 number)

If you do not make the payments due we may try to take the payment from any current or savings accounts you have with us, even if it is a joint account. Once we have taken a payment we will write to inform you that we have done so"

My question is can I just ignore these letters?

The DRO is so recent it's possible that the correct departments have not updated their records. You should remind them in writing of your DRO and give them your number.

Hopefully you're no longer banking with Lloyds as the overdraft was included, and your housing benefit payment and other benefit payments are now going somewhere safe.
  • yes, post it anywhere you like
    and thanks
