12 December completion date looking dodgy!

    But you can still exchange and complete before Christmas if the NHBC certificate is found in time after the hoped for 12 December. But you don't have to physically move your stuff out of storage and into your new home until you are ready. There's no rule that you have to move in the same day as you complete! That way your vendors are happy and get to move and you are happy having secured your new place and getting to choose when to physically move your stuff in. Just make sure you don't leave moving in too long so as not to invalidate any buildings insurance on the new place (usually allows 30 days empty but some are less/more). This is easier for you as you say there is no mortgage and you can stay with family.

    12 December came into the ring 5 weeks ago, and all clients were more than happy with that, as were the solicitors.

    In fact, at the time we were asked, providing we were all in agreement, if we were prepared to bring forward that date.

    The absence of the NHBC Certificate came into play just over a week ago due to a professional oversight by a supposedly competent person.

    Why should we make a significant unexpected additional financial outlay and move twice in a few days because of a solicitors incompetence? It's not why we employ these people is it?!

    Whatever you do, DON'T make a big song and dance to your vendor about how you have to complete by the 12th or you'll be homeless. In fact, if you haven't already, don't tell them you've already exchanged on your sale, as it's a perfect situation for them to gazump you. I'm sure it won't happen - most people are essentially honest - but don't go putting ideas into anyone's head!

    We complete on our sale on 12 December. That's done and dusted, money in the bank, and if we can't complete on our purchase then we simply go into storage and camp out with our daughter.
    We don't want a double move in quick succession, so why should we comply with the wishes of others when it's their legal team(s) who've cocked-up?
    Our vendor is desperate to move out of the area on the 12 December, and their vendor is already packed and eager to go.
    But it's only us who will suffer any financial delay!

    I thought this was your vendor's solicitor? You're not employing them at all.

    *they* may or may not have a complaint against their solicitor, but *you* don't.
    And as Notisis says, there's no reason at all why you should move twice before christmas if you don't want want to. Exchange and complete on your purchase to fit with the rest of the chain, and move yourselves and your stuff in whenever you want after that.

    You might as well ask the Wizard of Oz to give you a big number as pay a Credit Referencing Agency for a so-called 'credit-score'

    Wow How petty and mean spirited can you get.

    As you've ignored the question it appears your solicitor did warn you of the pitfalls of exchanging ahead of the rest of the chain (if he didn't then you have a legitimate complaint against him). Now because of your ignorance or arrogance (depending on whether your solicitor warned you) in not comprehending that even if all of the chain hopes to complete by a certain date....things happen and lead to delays -you are threatening to ruin the Christmases of the rest of the chain because you're not getting your own way (even though it makes no difference to you essentially if you complete on the 12th or the 22nd as you have the option to delay occupation til January as your family can take you in (bet they are thrilled ;) ) for no reason but petulence and spite.

    What the previous poster said. It's not even as if you are paying a mortgage or rent so you won't be out of pocket if you complete ASAP before Christmas and move into your new property at your leisure.
    You're missing a preferred date, not a legally binding one.
    To be honest, as everyone else has already said, it doesn't matter what someone else's solicitor has done in this instance. Yes it has affected you, but legally you have no recourse until after exchange takes place.

    I think it's bonkers to exchange on your sale before your purchase - just thank your lucky stars you haven't lost it completely. Yet. We've just completed on a BTL property that we put an offer on in July and in late October would have been gazumped on had our vendor not needed money quickly for a business venture.

    Wind your neck in and see sense, you can move in when you want but theres no point throwing your toys out of your pram, because it may not pan put exactly the way you want, its churlish, and just makes you look idiotic, and spitefull. Come on have some christmas cheer!

    Tried that. They don't want to incur extra expense of storage or move twice before Xmas either. It's their solicitor who didn't notice the absence of the NHBC Certificate until last week (3 months into the process).
