Can you pay rent to ex partner?

If a family were splitting up but wanted to keep the children in the house - but the father move out.

Can you pay rent to the father/ex ?

Situation is this.

Wife works full time, yet is entitled to CTC.. and prob WTC when split up, and will be entitled to a small amount of Housing Benefit. Husband (ex) is full owner of house. Divorce will completely lose the house and will cause distress for children.

Legal seperation will be done if necessary and a tenancy agreement can be drawn up.

    Surely the house won't be completely lost through divorce. If they are married the divorce courts can decide on what share the wife will get as part of her settlement I'd have thought. Just because the house is in the husbands name doesn't mean she won't have any claim on it.She needs to seek legal advice to find out what her rights are.

    Also, if children are under 16 the parent with custody usually has rights to reside in the house untill they leave full time education & it's only then the house will be sold & proceeds divided. This is what happened when my sister's marriage broke up.
    The bigger the bargain, the better I feel.

    I should mention that there's only one of me, don't confuse me with others of the same name.

    You can charge Rent to whoever you want... however for HB purposes they will class you as not liable to pay rent. Council Tax Benefit should not be a problem though.

    Seek legal advice. Although the husband is the sole owner of the house, the wife can establish an 'beneficial interest' to the property.
