Off-plan property - Refund of deposit

In August 2013, I paid £4,000 to an estate agent (EA) (knightknox.com) to reserve one of their buy to let properties. At the time when deposit was paid, development was in the planning process.

One month later, I changed mind and asked for refund. Estate agent refused refund till another reservation has been received on the same property. 3 months have passed and still there is no sign of EA refunding the paid £4,000.

At the time of payment, reservation form did mention deposit is non-refundable subject to developers terms and conditions. However, I have never received a copy of developers terms.

I was wondering if I had any legal options to explore to press Estate Agent to refund my paid deposit.

    Sounds like you need to get hold of a copy of the developers terms and conditions.
  • Sorry, you paid £4K without a seeing the T&C's ? erm......I don't know what to say. Why ?
  • Estate Agent booking form had this clause.

    "Note: Prices may be subject to exchange rate fluctuations if appropriate. Reservation deposits are non-refundable unless otherwise stated in conditions and purchasers are subject to the conditions and
    terms directly with the developer on contract."

    I was bit naive and did not explored contract conditions adequately at time of paying the deposit.

    Well unless it was mos sold I doubt u'll get it back
