Paul Simon-Faulty basement

Paul simon furniture company delivered bed basement after one month of ordering and it was faulty and the replacement came after one and half months that too was faulty. i sent an email asking for replacement as well as adequate compensation for loss of time and other expenditure to deal with , they now says that the compensation will be discussed only after completing the order. as a family we are devastated with this . where do i stand? once they deliver again what is the guarantee that they going to pay me the compensation? please can experts here give me valuable opinion ? what is the legal remedy, i'm very unhappy about their service.

    You're entitled to claim your losses back, such as lost earnings if you had to take unpaid time off work etc. What are the other expenditures you mention?

    I would compile a list of the expenses you think you have and I'm sure someone here will tell you if they are realistic. They have to be actual losses though.

    That seems sensible. There's no point discussing compensation now when you may very well have to take more time off work to receive their next attempt at fulfilling the order and therefore have more losses.

    Plus, as a consequence of the replacement faulty/damaged item, i have incurred extra cost for taking the time off from work and cost of time making this complaint. i ask that you pay me additional £300 to cover these costs.

    Frugal_mike, thanks for your reply, what if they dont pay compensation? they could say that they will be able deliver during the weekend which will have impact on my family out.

    i ordered at one of their branch.

    How did you come to the amount of £300?
  • I'm a software professional i get £200/day plus additional cost making phone calls etc..

    Is that £200 take home pay? Are you self employed, and if so does that £200 cover any expenses that you did not incur by taking time off work? Have you taken steps to mitigate any losses you're suffering?

    £100 for phone calls? Make sure you keep the itemised bills because if Paul Simon reject your £300 claim and say the losses are not realistic, you will need to go to small claims to get the money. You can only claim for actual losses though.

    As frugal_mike has said you need to take steps to mitigate your losses.
