Small claim satisfaction

I had default judgement for £3,348 .I agreed and Trader paid £3300 .However,Trader was over the 1 month limit .I have now asked him for the remaining £48 as it is at my discretion to issue date of satisfaction.
He could have done bank transfer but used cheque instead and the 5 days clearance took him over his 1 month limit.Which could mean 6 years CCJ for him.
I am thankful i did not have to use enforcement.But should i ignore the £48 ?(this is intrest so i am not directly out of pocket)
It has taken me 6 months to force my refund and Trader has given me lots of stress by failing to pay on 7 dates he guaranteed me he would - he toyed with me.
So now shoe is on other foot.
So what say you? - let bygones be bygones or stick to my guns and see how he likes it ?
Advice please - what would you do?

    I'd make the Trader pay the £48. They chose to make you wait for your money and now want to keep your money! Stick it to them!

    Personally, I'd take the principal and forget about it - it'll just drag out the stress and hassle and for the sake of a nifty might be worth moving on...

    just tell the truth, if he thought he'd be clever and drag it out till the last minute then it's sort of karma that he ends up with a ccj on his record

    leave it many never get their money because traders fold and phoenix a new company for the exact reason above, be thankful and leave it as satisfied

    Personally wouldn't chase the rest, I'd be happy enough having most repaid and knowing it will show as unsatisfied from now on
  • I think (not sure), if full judgement including interest is not paid in full, then will show as 'unsatisfied'..

    = no more credit for him, i hope!
    Long time away from MSE, been dealing real life stuff..

    It might only be £48, but it's your £48.
    The trader must have made a conscious decision not to pay you the full amount that the court order specified so IMO, you should pursue them for the remainder of this debt.

    It would be different if they had made an effort to pay you within the 1 month allowed, but it looks like they purposely left it until the last possible moment and didn't realise that it could end up biting them on the ar5e.
  • If you can't decide whether or not to try to get the missing money, ask yourself one simple question.

    If you had invested £3300 in a fixed term savings account and at the end of the term when the interest was paid, you discovered that the bank or building society had paid you £38 less than they should have done, would you say to yourself " it's only interest so I am not directly out of pocket", or would you try to get what was rightfully yours?

    £38 or £380. It's money that is legally due to you.
